PRIVACY & END USER LICENSE AGREEMENT (EULA)

This Privacy Policy describes how and when myVinotype™ collects, uses and shares your information when you use our Services. myVinotype receives your information through our website, partners’ websites, and mobile app (the "Services" or “myVinotype”). 

For example, you send us information when you take a Vinotype™ assessment from our website, update your personal profile, or download and use our app. When using any of our Services you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy.

Irrespective of which country you reside in or supply information from, you authorize myVinotype to use your information in the United States and any other country where myVinotype operates.

We collect and use your information below to communicate with you and also to provide, measure and improve our Services over time.

Information Collected Upon Registration

When you create or edit your myVinotype account, you provide some personal information, such as your name, username, password, country, language, gender, and email address. Some of this information, for example, your name and username, is listed publicly on our Services, including on your profile page and in search results.

You may use your account settings to unsubscribe from notifications from myVinotype. You may also unsubscribe by following the instructions contained within the notification or the instructions on our website. We may use your contact information to help others find your myVinotype account, including through third-party services and client applications.

Your account settings control whether others can find you by your email address. If you email us, we may keep your message, email address and contact information to respond to your request. If you connect your myVinotype account to your account on another service in order to cross-post between myVinotype and that service, the other service may send us your registration or profile information on that service and other information that you authorize. This information enables cross-posting.

Wine ratings, Tasting Notes, Following, Followers: Our Services are designed to help you share information with the world. Our default is almost always to make the information you provide public for as long as you do not delete it from myVinotype, but we generally give you settings to make the information more private if you want. Your public information is broadly and instantly disseminated. For instance, your public user profile information may be searchable by search engines. When you share information or content like photos or ratings via the Services, you should think carefully about what you are making public.

Location Information: You may choose to add your location in your Scans. We may use and store information about your location to provide features of our Services, such as creating lists of availability of certain wines.

Cookies: myVinotype may use cookies to remember you and personalize your web experience. Cookies are small alphanumeric identifiers that are stored on your computer’s hard drive when you interact with our web site. The cookies themselves do not contain any personally-identifiable information however they do allow us to recognize you when you return to our web site.

Most web browsers allow you to restrict cookies or warn you of their use through custom privacy settings. For Microsoft Internet Explorer 6.0 or above, this can be done by selecting Tools/Internet Options from the toolbar. Select the Advanced tab and click the box to override automatic cookie handling. Finally, check the desired boxes to control your cookie preferences. If you are using another type of browser, please reference their online Help utility to get instructions for setting your privacy preferences.

Log Data: Our servers automatically record information ("Log Data") created by your use of the Services. Log Data may include information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device and application IDs, search terms, and cookie information. We receive Log Data when you interact with our Services, for example, when you visit our websites, sign into our Services or interact with our email notifications. myVinotype uses Log Data to provide our Services and to measure, customize, and improve them. If not already done earlier, we will either delete Log Data or remove any common account identifiers, such as your username, full IP address, or email address, after 18 months.

Third-Party Service Providers: myVinotype uses a variety of third-party services to help provide our Services, such as hosting our various blogs and wikis, and to help us understand the use of our Services, such as Google Analytics. These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address.

myVinotype Checkout: If you submit an order request through myVinotype Checkout, we will share the order request and the order information with the licensed seller of alcohol ("Seller") that myVinotype has partnered with to fulfill your order request. Prior to the final submission of your order request, myVinotype Checkout identifies the specific Seller to which your order request and order information will be submitted. Consult the Seller's privacy policy for further information regarding the Seller's collection, use, and sharing of the order information.

Shared Information
myVinotype will not rent or sell your customer information to any third party without your permission. However, we may share customer information to third parties in order to complete normal business operations. All third parties must agree to abide by this Privacy Policy and take reasonable precautions to keep your information confidential. Types of third party companies that may have access to customer information include, but are not limited to, the following:

Hosting Service Providers (to perform functions and provide services)
Email distribution services (for company-authored emails)
Postal mail distribution services (for company-authored direct mail)
E-commerce services (for company-sponsored online commerce)
Shipping services (for wine and merchandise shipments)
Marketing research firms (for company-sponsored research)
Data enhancement firms (to correct or enhance customer data)

Law and Harm: Notwithstanding anything to the contrary in this Policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect myVinotype’s rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party's, including a government's, request to disclose your information. Business Transfers: In the event that myVinotype is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. The promises in this Privacy Policy will apply to your information as transferred to the new entity.

Modifying Your Personal Information
If you are a registered user of our Services, we provide you with tools and account settings to access or modify the personal information you provided to us and associated with your account.

Our Policy Towards Children
Our Services are not directed to persons under 17. If you become aware that your child has provided us with personal information without your consent, please contact us at info@myVinotype.com. We do not knowingly collect personal information from children under 17. If we become aware that a child under 17 has provided us with personal information, we take steps to remove such information and terminate the child's account.

 

Notification of Privacy Policy Change
If myVinotype makes a change to its Privacy Policy, the web site will be updated with the new policy and effective date. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
